This page states the legally binding terms “Terms” for use of the Medical Sales Connection and Independent Sales Network websites. These terms are between “You” the job seeker and Medical Sales Connection / Independent Sales Network “MSC/ISN/ISN”. MSC/ISN/ISN operates an internet-based interactive job post portal. MSC/ISN enables job seekers to submit their resume “Materials” and to network with potential employers or recruiters
”Employer”.
Medical Sales Connection may revise these terms at any time by posting an updated version to this web page. You may visit the site in the future to view the most recent and current terms. The following terms and conditions apply to your use of the services and to any content submitted to You in the areas hereunder:
ELIGIBILITY: You must be 18 years of age or older, or the age of majority as defined in your jurisdiction, whichever is older, to visit MSC/ISN in any manner. By visiting MSC/ISN, you are accepting these terms, You represent and warrant to MSC/ISN that you have reached the age of majority in your jurisdiction and You have the right, authority, and capacity to agree and abide to the Terms of this agreement.
CONTENT USAGE: By agreeing to these terms, MSC/ISN authorizes You to view content available on the MSC/ISN website for personal use. The contents of the MSC/ISN website are protected under both United States and foreign copyright, trademark and other laws. The MSC/ISN content is the property of MSC/ISN and its affiliate sites.
USAGE OF SITE/SITE PURPOSE: Time is valuable to you and the employers AND recruiters who post their positions on this website. Each posting lists the minimum requirements necessary to be considered for the position. Please read through each advertisement carefully before filling out an inquiry form. Out of respect, we ask that you only inquire about positions in which you are qualified. You must agree to the following terms each time you submit an inquiry to an employer as a reminder of our policy for participation. You agree to review the employer’s minimum requirements and will only inquire about positions in which You meet the minimum requirements listed on the employer’s advertisement.
You further understand that by applying to any employer listed on the MSC/ISN website, you do so at your own risk. Some companies chose to post job opportunities on a confidential basis. MSC/ISN will not be held responsible for the transfer of your personal information to the companies in which you make inquiry. Furthermore, MSC/ISN makes no guarantees whatsoever that your Materials will be considered for the position or that the employer will respond to your inquiry.
MSC/ISN does not necessarily monitor any Materials or Services posted, transmitted or communicated to or within the Site. If you have reason to believe that something on the Site violates these Terms, please contact MSC/ISN immediately.
USER SUBMISSIONS AND INQUIRES: You are solely responsible for the content of your inquires submitted through the MSC/ISN website , “User Content”. You agree that in submitting User Content, you will not impersonate any person or submit any materials to MSC/ISN or its affiliates that are false, inaccurate, misleading, unlawful or are otherwise in violation of your obligations to these Terms. Any information submitted must describe You, an individual person.
MSC/ISN is a passive portal for communication between job seekers and employers. MSC/ISN has no obligation to screen User Content, communications or information in advance and is not responsible for screening or monitoring User Content submitted as inquires.
SITE RESTRICTIONS: Users are prohibited from violating the security of the MSC/ISN by accessing data not intended for such user or logging into the server or account which the User is not authorized to access. Users are also prohibited from any attempt to overload, flood, spam, bomb or crash any part of the system.
Viewing and inquiries regarding job opportunities on the MSC/ISN may be used only for lawful purposes by individuals seeking employment and career information and employers seeking employees. The MSC/ISN may be used only for lawful purposes by individuals to network for professional purposes.

INDEMIFICATION: You agree to indemnify and hold harmless MSC/ISN, its successors, officers, directors, employees, designees and agents from and against any and all claims, actions, demands, costs, liabilities and expenses (including reasonable legal and accounting fees) arising or resulting from the Materials. Your use of the Services or Your violation (or alleged violation) of your obligations hereunder. IN NO EVENT SHALL INDEPENDENTSALESNETWORK.COM, ITS SUPPLIERS, OR ANY THIRD PARTIES MENTIONED ON INDEPENDENTSALESNETWORK.COM SITE BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, LOSS OF EMPLOYMENT OR DAMAGES RESULTING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE INDEPENDENTSALESNETWORK.COM SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT INDEPENDENTSALESNETWORK.COM IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
INDEPENDENTSALESNETWORK.COM'S MAXIMUM LIABILITY ARISING OUT OF OR IN CONNECTION WITH INDEPENDENTSALESNETWORK.COM, REGARDLESS OF THE CAUSE OF ACTION (WHETHER IN CONTRACT, TORT, BREACH OF WARRANTY OR OTHERWISE), WILL NOT EXCEED TOTAL AMOUNT PAID TO INDEPENDENTSALESNETWORK.COM.
LIMITATION OF LIABILITY: Medical Sales Connection, a division of Medical Sales Connection, LLC may contain inaccuracies or typographical errors. Medical Sales Connection makes no representation about the accuracy, reliability, completeness, or timeliness of any content. The use of independentsalesnetwork.com is at Your own risk. Changes are periodically made to independentsalesnetwork.com and may affect the website at any time.
MSC/ISN does not represent or guarantee the truthfulness, accuracy or reliability of User Content or any other communications posted by Users or endorse any opinions expressed by Users. You acknowledge that any reliance on material posted by other Users will be at your own risk.
You acknowledge and agree that You are solely responsible for the form, content and accuracy of submitting your resume and supportive information for potential employment to any companies listed on the MSC/ISN. MSC/ISN shall not be responsible for any employment decisions, for whatever reason, made by any entity posting jobs. You acknowledge that MSC/ISN is not your agent with respect to employment actions and/or record keeping obligations, and that the employer is solely responsible for complying with equal opportunity laws and any affirmative action obligations to which You may be subject.
MSC/ISN acts as a venue for employers to post job opportunities and jobseekers to respond to these openings. MSC/ISN is not involved in the actual transaction between employees and job seekers. As a result, MSC/ISN has no control over the User Content, the quality, safety or legality of the jobs or the information the submitted by the job seeker. MSC/ISN has no control over the truth or accuracy of the listings, the ability of the employers to offer job opportunities to job seekers or the ability of job seekers to fill job openings.
Please note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, foreign nationals underage persons or people acting under false pretenses. You assume all risks associated with dealing with other MSC/ISN Users. You are expected to use caution and common sense when using the MSC/ISN website.
You release MSC/ISN from claims, demands or damages of every kind and nature, known and unknown, suspected and unsuspected, disclosed and undisclosed, arising out of or in any way connected with such disputes. If you are a California resident, You waive California Civil Code Section 1542, which says “ A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.”
EMAIL CORRESPONDENCE: You authorize MSC/ISN and its affiliated sites to send You a reasonable amount of e-mail or other correspondence, including but not limited to, marketing promotions, special events and general information regarding MSC/ISN and its affiliated sites.
LINKS TO THIRD PARTY WEBSITES: Links to third party web sites on the MSC/ISN are provided solely as a convenience to you and are not necessarily under our control. If you use these links, you will leave the site. You acknowledge that MSC/ISN shall have no responsibilities or liabilities whatsoever for the availability or the content or privacy practices located on or through, any such linked site.
VIEWING OF WEBSITE OUTSIDE OF THE USA: MSC/ISN makes no claims that independentsalesnetwork.com Content may be lawfully viewed or accessed outside of the United States. Access to the Independentsalesnetwork.com Content may not be legal by certain persons or in certain countries. If You access Independentsalesnetwork.com from outside of the United States, You do so at your own risk and are responsible for compliance with the laws of your jurisdiction. These Terms are governed by the internal substantive laws of the State of Missouri, without respect to its conflict of laws principles. Jurisdiction for any claims arising under this agreement shall lie exclusively with the state or federal courts within Missouri State. If any provision of these Terms are found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. In addition, MSC/ISN’s failure to enforce any term of these Terms shall not be deemed as a waiver of such term or otherwise affect MSC/ISN’s ability to enforce such term at any point in the future. Except as expressly provided in an additional agreement, additional Terms for certain areas of MSC/ISN, a particular "Legal Notice," or software license or material on particular Independentsalesnetwork.com pages, these Terms constitute the entire agreement between You and Independentsalesnetwork.com with respect to the use of MSC/ISN. No changes to these Terms shall be made except by a revised posting on this page.
These Terms constitute a binding agreement between You and MSC/ISN and is accepted by You upon your use of the Independentsalesnetwork.com website. By clicking the "Agree" button on the Resume Submission form You represent that You are capable of entering into a binding agreement, and that You agree to be bound by these Terms.
BINDING EFFECT; APPLICABLE LAW: This contract shall be binding on and/for the benefit of the parties and shall be construed and enforced in accordance with the laws of the State of Missouri.
